Week One: Negotiations Completed




What a week! We started Monday morning and went straight through to Friday - about 9 hours each day. You can ALL be REAL PROUD of the people that you sent to that table. I believe that the ABINBEV reps see that we have sensible, knowledgeable and fair minded people representing you. Bargaining has been very polite, upfront, candid.

We have discussed many issues already but there is much more work to do.


Some of the subjects discussed so far have been disciplinary procedures, warnings, warning system, write ups, life of write ups and how you challenge a write up, grievance procedure, holidays, vacations, overtime, lunch and break periods, hours, supervisors, safety, tools, medical leaves absence, military leave of absence, return to work rules, company doctors, hours of work, vacations, shutdowns, medical emergencies and attendance policies.

Other discussions were about policies concerning days off, occurrences and what counts as one and procedures that are not clear.


Many times this week it was said at the table that it was a shame that EVERYONE can't be at the table and see the process work. It is truly an amazing thing to be a part of and observe. It works best with all people contributing and discussing their thoughts and the feelings of their co-workers about the subjects at hand.

That is exactly what is happening - you are extremely well represented!


Now we go home and study too. We have one week off and then we start up again for another week straight. We will be revisiting most if not all of these subjects. Every time they make it to the table they are further refined.

So we are moving forward and this negotiation has our full attention. Talk to your reps - keep telling them what is on your mind.


To the few who still resist the effort to give the workers a fair contract - some even within our own ranks - I say this New York Style: fagedaboudit!


The outcome of any contract is so much better than continuing to have no say. Everyone knows that if you are AGAINST that then you are against workers as a whole. We believe most people are not against themselves, their co-workers or their own interests.

  2. I found out the following this week while at Negotiations:
    I never realized how blind we were to think that we never had things in writing.
    The number of things we had to discuss and rehash over and over again to try and make things right for us.
    I found out how many variables there really were in our local management on running of our facility.
    Not to say everything was bad but not much was consistant.
    I urge everyone to support your Reps because they are working hard ( on their own time ) to make things better for all of us. Some are even thinking of Swapping out just not to miss out on anything important. If anyone can do a Swap for a Rep please do so if asked.
    I also found out that when we are done it will be the best we can get.
    To those who voted no you would've found out that you would've gotten nothing anyhow with no say.

  6. I am one of the many reps voted in by the people to help get things right . I can tell you this ,WE are finally going to get everything and I mean everything in writing so there will no longer be any case by case for anyone . All the talks this week have gone well. The company now knows some of your CONCERNS. We will not stop until all of the issues are finalized. We have some great people in negotiations. You all really got it right in the people that WE chose to be there for US. There is no time line for the contract. It will get done only when ALL of the issues are in writing and not just in someone's head. The next item is for all of you who are really into this movement to start showing INBEV that this movement is REAL and what I mean by REAL is a show of support for the UNION. That is the only way WE can get this contract done in the way WE all want things to go . I have to say I really learned a lot this week ,and I look forward to the weeks ahead to finally get everything in writing . Stay strong ,and know that it's good that everything is going in the right direction. I can't wait for Decemember 13 for the next talks to start !

  7. 8:53AM - Thanks for your offer to help! One problem with that now is at this time it really wouldn't be fair to the company to have that much of an open door to the negotiation room.

    That is why early on I structured each crew with up to four reps so everyone would have a really good chance of participating if they wanted to. Each crew voted the reps on their own crew in to the room. It is possible that you were busy then or may just have not had a strong interest at that time and that is completely understandable.

    I do appreciate your offer to come now and give your time and support but my other problem would be that every worker who wants to do the same would not be able to. Contact me and we can talk - ask your rep for my contact info.

  10. Sat thru some good meetings. Reps really brought up some good examples of concerns to legal guys. Gotta say they are a hard working bunch. Like a dog on a bone they dont let go and they growl when you try to take it away!

    * Intelligence
    * Loyalty & Trust
    * Mechanical Ability
    * An Attendance Record that any other company would love to have
    * A Desire to make things right
    * The Ability and Knowledge to Manage our own Shifts with nothing extra for it.

  20. Hey 6:06 did they ever ask for your input last year? How about the year before that?Did you have a say in it before? Will you have a say if we dont get a contract in the future? My point is we are not done yet with negotiating the contract and only when we are done will we know for sure what the final outcome will be. Everytime a contract is signed you know what the future will hold for you.They cant just take away next year because THEY say so.We negotiate whats our future.When its time for us to discuss whats in the contract, it will be discussed. Please be patient as we will take the appropriate steps to formulate the contract with the company.Thank you.

  21. The negotiating process should not be rushed.

    We need to have a contract that shows us AB Inbev values our work and cares about us as people. One that makes policies clear so that Managers jobs are easier and hourly employees know exactly where they stand- clean away as many "grey" areas as possible. That takes time.

    We must find away to incorporate all the great ideas we have built into our plant plus the new ideas that will positively impact MCC Newburgh's contribution to the AB Inbev earnings goal, while at the same time not sell ourselves short.

    I am sad and very disappointed that after 20 years we have gone from the inclusive Pro-employee operational concept to having to hire a Union.

    Whether you voted for the Union or not, the Union is here. If nothing else, the Union is an opportunity for us to make positive change. So, let's give it our best on both sides of the negotiating table to make it work.

    Let's take the time to create a contract that will make life better for hourly, salaried and AB INBEV alike.

    The strive for excellence takes time, hard work and commitment.

  29. I dont trustem either. They have stuck it in our asses for so long that my doogin doesnt have a tapered end anymore. How can you trust a company that is ok asking people to accept no raise and no increase in our pensions then they give huge bonuses to the leaders of the company. They cut from everyone else but themselves. I dont trust them for a second.

  30. A rep, dont get lulled by them being nice in the first week of negotiations. The company has a huge history of manipulating things for their long term goals. You know what sounds fair to Tony? We take a pay cut because we dont deserve to be compensated like we are, because somewhere else people make less money and they should go up and we should just be ok with staying where we are. I bet ya he didnt stay at the same rate as the previous year though.

    I was very proud to sit in on the negotiations and to see what a great process this is and how we now have a voice in everything we do. And yes Diane I also am very sad it has come to this because our company and mgmt. has decided that pro employee is not the way anymore. we now must fend for ourselves and there is no better way than to follow the lead of Sam, Steve and john!! you can really tell these guys have their shit together and to see the looks on Dan and Dave's faces as they see they can't push us around anymore it is PRICELESS!!!! That is our christmas present all my brothers and sisters. Trust me when I say that things are going well and continue to talk to your reps and let them know your feelings. One week off and back to the table I for one am very excited about this. Lets keep the ball rolling and stay strong to our UNION cause. We have already gained so much that this is a win win situation no matter what. we see how our life has been so much better since the vote. Stay strong all my brothers and sisters.WE ARE UNION WE ARE PROUD!!!! nobody can break this binding that we have with local 363. UNION STRONG!!!!!!!

  39. can the reps please ask the company to supply a yearly statement that includes our start date, years of service,how much time is accrued in my pension fund and how much is my pension worth. I only get statements telling me information on how much is in the entire pension fund and total liabilities but nothing for me as an individual. Thank you.

  43. we can call st.louis now and they will send it. People on the floor are ignorrant to the fact that the statement we get every year only has what total pension fund has in it and its pay out liabilities are. It does not have your name or start date or what your account is worth. I asked a few people on the floor if they had any documentation that shows what THEIR portion of the pension is. All said the per month per yr. number we were told what we get.Nobody has any documentation that says what his or her start date is and what we are entitled to. Who you contact or how to start collecting your pension. You have to contact st.louis. I want everyone to have that information now because if something happens people need to be prepared ahead of time.

  49. Hey everyone just to let you know we are working on all the issues that you all are talking about. The next round of negotiations are coming up next week and we will be pounding away each day at the table to get us the best possible contract that we can. Don't lose sight of the fact that just to have our first contract in writing is a win win situation no matter what! We will hold the company accountable for everything they do and people will be protected like they should be. REMEMBER everyone for any questions please talk to your reps and let them know your concerns or if you have a big issue just contact Sam and he will respond to your issues. We have the train rolling and we will take whatever time it takes to make this contract right and to get us at mcc newburgh a solid contract that we can all be proud of.   55. I agree too. I'm sick of listening to the few who either don't understand, don't want to understand or are not smart enough to realize that we need a contract now. Any contract?? No the best one we can get. That is the contract I want. Our reps will do the best they can they are putting in a lot of time and effort for us all. It is the company who has to step to the plate and work things out with us. It looks like we are on the way to having that happen. Well, I know one thing, any contract will protect us all, no contract screws us all. So I wouldn't ever go "big mouthin" against the union and our reps or what contract they can get for us, if you work as an hourly support their effort whole heartedly they are right to say "get with the program". We all should be. Anything else is just foolish effort against ourselves.

They are most likely salaried people.There is no sense in getting upset over someone elses comments about what we are trying to accomplish.If the person that is making the comments about what he or she thinks is important then let them voice their opinion. The truth that everyone must decide upon is only theirs to interpret. If someone feels strongly about an issue and brings forth the logic that supports their view then we must as individuals take that information and make an informed decision. So also should that person not deny the truth that confronts us all. That together we stronger than apart, and only the voice of our union, can,will be and has been heard. The facts are undeniable. We the union have already made the company sit across from us at the table and listen to our concerns. Being in negotiations has been able to delay increases in our medical costs, and stopped any changes that could be made to further our downward slide while the managers on top keep going up. We are in the process of writing down our contract,binding both sides to keeping promises to eachother. Ones that will ensure our success in the future for all of us, Salaried and hourly.

  59. Wages and pension are very important to me. How much of an increase are we looking for in the contract? Has the company been willing to deal in those two areas? Has the medical costs already been addressed at the table? Is the company still wanting us to pay for 35% of medical? You guys are doing a great job. These are real questions.   60. We have not discussed those two items at the table yet. We will be going over those items in the later sessions. Right now we are going over many of the rules and policies that you "had".

    We are finding out there are as many opinons of what the rules are and what they mean and how they are applied as there are people working at the plant.

    The fact is that we are finding out that there were many things that were not on paper and were described by management as "being in my head".

    It has to be on paper from now on and signed.

    There is much work to be done clearing things up so people will absolutely understand that there are one set of rules. We need to get to the point where everyone will understand them and know them.

    Example - no one has a copy of your full attendance policy or can really specify the hard rules of that policy.

    This speaks back to those who don't see the full benefit of just having a contract. It is not just what you had - it is what you had and MORE cleaned up, logical, fair, legible, readable and distributed to you for your use and knowledge.

  64. All policies will be in black and white writing in order to eliminate "depending on who you are" policy from the old MCC. managment. Tink about how many of us that were treated unfairly because a policy was interpeted by Human resource or anyone else on the mgt. team. This is most important because you could lose your job your pension your benefits , simply because they have the power to do so, not in the future you will know the rules and be represented.

  65. How many have filled out the company's engagement survey? No, I don't give a shit about the pizza thing if 155 people take the survey. If you took the survey you could have made your opinions known all the way up the ladder. Name names, who pisses you off, why Inbev sucks, whatever. A great opportunity to voice your opinions. I did. If they want to give you the microphone to voice your displeasure, opinion, whatever. Do it. I'm sure some of my comments will be on the powerpoint presentation. You too could have a few moments of notoriety, be creative but brutally honest.
    For those of you who are restless to see "THE CONTRACT" wait until we're done writing it, OK? Then you can sit down with your personal copy and read it. Read it thoroughly. It's your future with MCC/ABInbev. What amounts to about 70 some odd pages of legalese. Ask questions here on the blog about what you don't understand. But be patient. This document won't be in your hands for a while. We worked for several sessions to make a presentation. We presented, they went back to St. Louis to ask what is OK with their bosses. We start again 12/13. More of the same. It comes down to the interpretation of one, yes 1, word can mean a whole world of difference in meaning and how a passage is applied. When we present this document to all our fellow team members you will be reading the many hours of work compiled by both the company and the union. Slow? youbetcha. Important?
    Have you ever seen the Motor Vehicle and Traffic code? Did you know driving in NY State is a priviledge? Not a right! It's longer than "War and Peace". But it's your contract with NY to drive your car.
    Well, ours will be shorter but, it's our contract with MCC to drive the plant.
    The DMV code is still a work in progress, since 1910. So's ours.
    The point I'm trying to make is don't be in such a rush to see a contract. Such things aren't rushed. And when it's agreed to in principle, read the damn thing and make an informed decision. Is it a good one? Vote for yourself first with all of us in mind.

  66. We are at the start of something historic. We are about to change the way Americans view union workers. In the beginning of unions in America, the reason for banding together was due to working conditions and low wages.Then after a long period of time the reason for unions were the same but they didnt get involved enough in the decisions that affected their business. They became powerful in numbers, and began changing the way business was done in America.Some unions, were only considering their members and not dealiing with the problems that faced their employers because their employers wouldnt allow their employees have a say in the processes.
    We have experience at Metal container of getting the employees in decision making roles using statistical process controls. We are the owners of the processes. We founded this plant on a concept created by Demming. He found a way to make manufacturing efficient and improved quality.We used to use these concepts on guidelines on how we run our plant. We got away from the concepts that made us a leader in quality and changed our industry.
    Our CEO at that time was Barry Baracha. He took our company from a concept to reality.We as 363 union members are ready to recapture that dream, that concept.We are fearless. I hear that our management at ABINBEV is just that.
    I say to Brito "prove it". Lets show America if not the world that we can change the way business is done. Making the concepts that Demming created to guide our decisions again.
    Inspire us by commiting to us and us to you that we will never be satisfied with our results and we will continue to work for the targets that are set.
    Our contract will tie the knot that holds our dream together. We are working towards this goal.We are ready to continue with negotiations this coming week with fair and good intentions.

I agree that the company talks a good game but has fallen short in many areas.I can feel the enthusiasm returning everytime I talk to our reps. I hope we can come to an agreement.Keep going reps. I know that they will settle on a wage or pension increase that will make everybody happy. Finally we have a voice and that voice is screaming 4% across the board. Proud to be union made.   71. We can bring that up at the table for you. Possibly an allowance for workshoes each year. Uniforms are something that would need to be discussed at a meeting to guage the support for them - that subject always prompts heavy discussion.

  73. We are continuing discussions about personal tools and company tools this week. Allowance can be brought into the discussion. I cannot guarantee the company agreeing but we will make the case. It's something that just about all will benefit from. "Tools" is a subject area that believe it or not there was confusion on what things meant. We are looking to clear it all up. Doing so will help the employee and the company.

  77. The company was planning on doing away with our pension. And also planning to increase our cost for health benefits. Our committee can get in there and talk about it now. Anything they can do will be an improvement.

Its important enough for them to write it down. be glad that they care enough to do that.I agree that the big 3 are going to be the focus but we didnt like it when the company told us what we were supposed to care about , and that our concerns where not important until the union drive.We should not rush to accept just any contract. We should work hard on getting it right.Shoes could come at a later time I agree but lets not discount someones concern just because we dont have the same point of view.

  80. Oh Mr. Kotter....Practice what you preach.....I didn't blow them off. If you read the whole thing I wrote and I went on to say that Shoes and Uniforms might be important. I never mentioned anything about rushing a contract either. I'm a Rep and I'm working Dam hard to get this done. You finally agree that Shoes can come at a later time.   81. If we all want the best contract we can get then it would be smart to start openly showing that we back the union and our reps. Everybody not just the brave few. The company needs to know that we all want a good contract. The time for bullshit and hiding it is over. Don't come out of the closet after the fact and wonder why "we" didn't get more. Come on out and help push the cart now.

  83. Boomer is right. We need to support the IBEW. They have our best interests at hand. I'm sure everybody's concerns are in the contract and not just from the chosen few. The big three, pension, wages, and bennies will not be settled on.The reps have listened to the voices and the voices are all screaming 4% across the board. They will not let us down. Go IBEW. Go REps. Proud to be union made. Is the contract 1, 3 , or 5 yrs?
