Union Busting School - Learn The Secrets So You Know It's All FAKE



Let's get educated about what happens when employees want to organize to protect themselves. Let's talk about how a company will try to scare the workers out of wanting a union. This usually happens more after the election is filed for. You will see that anything goes. Fear, promises, threats whatever it takes to keep you from getting that contract.

IBEW Local 363 wants you to be educated so that YOU CAN RECOGNIZE what is going on when the company, the supervisors or any firm or "consultant" that is hired tells you that the union is not the right choice for the Newburgh plant.

It is all for the company benefit and none of it is for your benefit. In fact, it is all to help convince you to turn on your fellow workers and yourself.

They pay these people a lot of money to EDUCATE THE SUPERVISORS and SCARE THE PEOPLE OUT OF TRYING TO MAKE THINGS BETTER FOR THEMELVES.

You guys are WAY too smart for that. Some of you have actually been through this already right here at the can plant in Newburgh.

Remember the COMPANY PAID courier delivering last minute reasons to not vote for the union last time? Big mistake on the workers part - look where we are now.


SADLY, IT SEEMS THEY WILL SPARE NO EXPENSE TO KEEP YOU WITHOUT A CONTRACT AND IN A WEAK POSITION.


We say they should spend that money on positive things for the workers and NOT spend the money to fight against them. All they want is a fair chance and a say in their job - to fight that is ridiculous and unneccessary.

With IBEW Local 363 we can all be on the same page! Union workers and the company! There is no reason for it to be anyway else.

When we have our union here we will make this company a better place to work and the employees will be more productive KNOWING THEY HAVE SOME SECURITY.

Worth Repeating - Carlos Brito Explains About Negotiating In His Own Words



Here's Carlos again. Let us look AND LISTEN CLOSELY at how he describes HOW INBEV AND AB WORKED OUT THEIR RELATIONSHIP AT THE BARGAINING TABLE.

He proudly speaks of "coming to the table" and bargaining fairly, "reaching an agreement" or "an agreed deal in a friendly fashion", "entering into negotiations", he acknowledges that and says "working together we can do more". He says "not at all" to any changes to employees. He talks about "having a game plan", "working hard" to "build this great company together", of "rolling up our sleeves" and "working together as a team" and the ultimate - to "make our dream come true".

IT SEEMS THAT CARLOS BRITO is in full agreement with IBEW Local 363 on all of the above. We believe the SAME THING SHOULD APPLY TO THE NEWBURGH PLANT WORKERS. WE JUST WANT ALL OF THAT TALKING, SITTING AND BARGAINING TO ALSO BE DONE FOR THEIR BENEFIT - SO THEY CAN FEEL THAT THEY ARE REALLY PART OF THIS NEW COMPANY.

THE WORKERS AT THE NEWBURGH PLANT NEED A CONTRACT TOO - JUST LIKE THE CONTRACTS INBEV SIGNS EVERYDAY FOR EVERYTHING ELSE THEY DO.

The employees here deserve to KNOW WHERE THEY STAND and to not have to walk on eggshells every working day of their life.


On August 27 and August 28 we will begin OUR DREAM for our future AND OUR CONTRACT with AB Inbev.

What time: 2:30pm and then again at 7pm.

Directions: Take NYS Thruway south and get off at Exit 16 Harriman - after paying toll take first exit on right and stay in left lane - take a left. Follow straight and take a left at the 5th light onto Commerce Drive South. IBEW Local 363 is last building on the left side.

Let's Get Organized And Talk About A Meeting




People have been asking to discuss having a meeting. With EVERYBODY there. I will start the discussion:

First of all I would like to welcome all of the management people reading this. Just so you know, it doesn't matter if you know any of this. In fact, used in the wrong manner it would violate Federal Labor law for you to get involved in it in ANY way.

I think that we need to have a meeting with everyone invited and really look at what the group as a whole wants and expects. We need to have questions asked and questions answered so EVERYONE understands the great opportunity in front of each and every one of you.

The meeting is important and if it needs to be at night or day - we are ready to help it happen. The group needs it to see the power they have TOGETHER. And you can ask us anything you would like and all hear the answers at the same time.

So here is an idea:

LOCATION: The IBEW Local 363 Building location is a perfect place for the meeting. It is located just south of Woodbury Commons at the same exit. From the NYS Thruway Newburgh toll booth it is just 20 minutes to the building going south.
The address is: 67 Commerce Drive South, Harriman, NY 10926

We have a meeting hall that can hold over 500 people and also a lecture room that is available to us ANYTIME. Parking is available for that same amount of people. It would be great for everyone to see what 363 is all about.

Commerce Drive South has only three businesses on it - we are at the end of that road. Actual directions to follow if we choose to meet there.

DATE: We can make the date any day including a Saturday or Sunday if that works out best.

Would meeting on Sunday evening be a time that EVERYONE could meet at the same time? That would be the best way to meet - if it is even possible.

SHIFTS: We will set the meetings at a time that allows everyone no matter what shift they work to attend.

NOTICE: We will post it here loud and clear what day and time it will be.

POLICE: On the night or day of the meeting I will notify the Harriman police that we are having a meeting I will ask them to keep an eye on our road for any "management looking" people. The police don't like people hanging around, parking around and loitering on their streets here either.

Managers: Remember it is a Federal Offense to spy on a union meeting. Our construction apprentices will be outside and on the street looking for you and they would love to catch you breaking the law. They might even get a reward for helping out and snapping your picture.

So let's discuss having a meeting right here. WHAT IS YOUR IDEA? DO YOU HAVE A BETTER PLACE TO MEET? LETS TALK.

Then take every letter and every fact sheet Dan EVER gives you, add to that every anti-union "consultant" the company brings in, hires and pays who gives you advice and information about organizing and unions and throw it all in the garbage.

If you have no contract at this plant - you will be in the worst position you can be in.

With a contract you have a chance to make things better EVERY time an issue comes up.


The article makes me sick - any cuts they make will go toward the BILLION dollar bonus for the "fabulous forty" .
Sickening.

Dan Kimutis: Whose On First Dan?




Just read the letter from Dan Kimutis to the "team members". Funny how we are "team members" and that's ok - but UNION MEMBERS isn't - Hey Dan - we're going to be both!

Nice try with the letter Dan but the canned responses are lame. Looks like Dan is either confused himself or wants to confuse the people. Who's on first Dan?


Of course he didn't give the union the addresses - we don't need him for that. This isn't about how people got addresses its about a contract.

Dan was right on ONE THING in his letter - forming a union at the plant is the biggest work-life decision you will ever make. You are deciding, once and for all if you would like to have a fair and legitimate voice at your workplace with a fair remedy to address concerns with your employer......OR NOT.

Lets face it, after that, Dan is just another company hack trying to fool the people into believing that being against themselves is the right thing to do.


Can't we all just get along Dan? The union is not a monster. We are fair! A vast MAJORITY OF THE WORKING PEOPLE AT THE PLANT WANT A UNION AND WE HAVE THE PROOF. .


Want the proof first? In order to protect the identity of the employees who signed cards - Let's get our Congressman or County Executive to compare a list of the employees you give him with the cards we have to confirm it. It's a landslide amount we have already.

WHY DOESN'T THE COMPANY JUST RECOGNIZE THE UNION? Let's sit and TALK for the good of everyone in a fair setting.

The people want a voice Dan - it's REAL THIS TIME.


Back to the letter: Dan shouldn't worry about tapes or video hats - if he isn't worried about getting caught on one breaking federal Law by violating the employees rights. Will we bring him to "court" if he does that? You bet your ass we will Dan. You or any other of you management guys reading this everyday thinking you are slick. You had better school up.

That brings us to the part about the union bringing lawyers in. Here's another union promise - we don't NEED a lawyer. But I bet the company will be hiring one though.

So Daniel, who is the COMPANY LAWYER going to be fighting against? It can only be the workers. The workers that have authorized IBEW Local 363 to represent them.

Spend money on the workers not against them.

Dan said in the letter to ask him any questions.

You say "Fact 1" is the union cannot guarantee that if given the chance they will be able to negotiate a better deal than you have now.

WHO will stand in the way of that happening Dan? You say it as though it cannot happen. It could. Right now - with no contract - we have no guarantee and no chance.

YOU say...since the union is not willing to strike, I am not sure what they intend to use as leverage to force the company to agree to something it does not want to agree to."

WHAT would be the list of certain things that the union would be trying to force you to agree to that you would not want to agree to? Please tell us the ones that would force US to use leverage.

YOU say...."FACT 2" Neither this union or any other union can guarantee that a company cannot make changes.

WHERE you miss the point Dan: The employees cannot guarantee a company cannot make changes without a contract.

In FACT without a contract, the employer can make unilateral changes at any time, can do so without notification, switch the rules back and forth to meet the company needs at the time and no employee can say anything or question it.

In FACT, with a contract the company CANNOT make unilateral changes, they must discuss, negotiate and fairly bargain over the affect on the employees and both parties must agree.

I notice a slight unintentional hint in your words Dan - "CHANGE IS and WAS INEVITABLE"

You're right on that too Dan.

About a minute and a half into this video Mr. Brito is asked if there would have to be any changes to the employees. His answer is - "Not at all".

Worth Repeating - IBEW Local 363 - We Are On Your Side!



There is a movement building at the can plant. That movement is for the BENEFIT OF THE WORKING PEOPLE. The handwriting is on the wall in regard to what the company plans are for us there. They do not have the workers interests in mind at all.

WHICH SIDE ARE YOU ON?

THE PEOPLE HAVE DECIDED TO FORM A UNION TO PROTECT THEMSELVES. The people are banding together to speak as one voice. THE PEOPLE WANT to sit at the table - with management - and work out a FAIR and WRITTEN contract.

The comments and misleading statements by our management have already started in an attempt to intimidate and scare the people to stop the movement to organize.

BUT THEY CANNOT STOP IT! The people know what they need to protect themselves and their families. THEY NEED A CONTRACT. A WRITTEN CONTRACT.

Why does the company fear that so much? The answer is because without that contract they can take away EVERYTHING the workers have - and the workers have no right to even question it.

Take any of the "advice" in regard to forming a union from the management crew who are being paid to keep you weak and separate and toss that "advice" right in the trash. It is always scripted, forced, twisted and designed to make you work against yourself and your co-workers.

THE WORKERS ARE MUCH SMARTER THAN MANAGEMENT THINKS.

Why do managers try to intimidate, scare us, lie to and threaten us that we will lose everything with the union? That's Bull. Why are our good workers being questioned about the union? Why? We have proof! We'll play it for you if you would like.

We understand that OUR MANAGERS will do ANYTHING to talk or scare us away from wanting a contract. We feel it is not their business. It is us mature adults who will decide what services we purchase and for what use. WE'RE GETTIN A UNION IN HERE NOW.

All We Need Is A Contract

It's really that simple. With everything changing so fast at work, now is the RIGHT TIME for us to come together and bargain with the company as a unit.

This is not a push to take from the company or to push for unreasonable demands. Not at all! It is to help us, the people who are scraping to stay in the middleclass. We just need a little bit of protection and there is definitely safety in numbers.

So please - all of you supervisors reading this - don't make us the enemy. We are on friendly terms with most if not all of you. All we want is to have our right to organize a union to be respected. You see what they do, are doing and can do to YOU already.

We want it better than that.


Without a contract, we are at the total mercy of people who make decisions without thinking too deeply about our needs - and our concerns.

Having a union will put us - the workers - directly at the table with those same people. If we are at the table, involved in the decision making, we can make sure that our concerns are heard and our needs are met.


This IS NOT US AGAINST THE COMPANY. Not at all.

This is US FOR US.

No matter who tries to say it differently - that is exactly what it is.

We want and need a way to protect ourselves and indirectly, our families and that way is called, "a contract".

This site is dedicated to the workers at the Newburgh Can Plant. In these tough economic times it is very stressful for every middleclass family when it comes to worrying about work or what will happen at work.

It is less stressful when you work under a written contract. After all is said and done - the bottom line is that the workers wanted a contract.......and THEY made that happen.
