It says: "The undersigned agent of the Regional Director certifies that the results of the tabulation of ballots cast in the election held in the above case, and concluded on the date indicated above, were as follows........A majority of the valid votes counted plus challenged ballots has been cast for IBEW Local Union 363.
The certification is signed by the Board Agent, the company attorney and IBEW Local 363.

THE FIRST MEETING OF THE NEW IBEW LOCAL 363 MEMBERS FROM MCC NEWBURGH will be held on Thursday September 2 and Friday September 3 - 6:30PM EACH NIGHT - in the IBEW Local 363 UNION building at 67 Commerce Drive South, Harriman, NY 10926. Maintenance Crews day will be at 5:30PM on Thursday September 2.

The UNION building is exactly 20 minutes from the Newburgh toll booths on the NYS THRUWAY. Take NYS Thruway to Exit 16 Harriman - after toll booth take first right and get in the left lane - make a left and drive to the fifth traffic light and make a left onto Commerce Drive South (see AMSCAM building on corner) Follow Commerce Drive South all the way to the back we are the last building on the left side. That is YOUR NEW BUILDING.
We will have food catered and after celebrating our victory we will begin our process of preparing to negotiate. In addition to helping you all organize and spending what seems like 15 hours a day including weekends on the Blog since June - I have also been working on putting together a template contract that is made up of what benefits and conditions you have now and while also leaving room for what we might want to add. It is far from being complete and is for discussion and starting purposes only.

MCC - IBEW 363 Workers Find The Eye Of The Tiger
Well, the first half of the voting is all done - we are halfway there! At this time, no one knows how many yes ballots there are or how many no ballots there are. I have been at the beginning and the end of every voting session starting at 4:30 AM just as I will be tomorrow.
Now the next two shifts will have their turn to vote and have their say in regard to this election.
Get used to voting - in the union the people vote on everything we do.
I have a message for all of you who have not voted yet:
At this point, you will decide if Local 363 is chosen in this election. That is good news! We have MUCH SUPPORT on your crews!
You will decide if you and your coworkers will have a say, a union or a contract. You will decide if any negotiations about anything EVER happen at MCC.
You will decide if you and your coworkers can lose pay and benefits with no chance to discuss the subject if they remain at-will employees and have no way to get a contract.
You will also decide if IBEW Local 363 is certified as the representative and if you and your coworkers can have a seat at the table to discuss ALL ISSUES THAT COME UP NOW AND IN THE FUTURE.
The 'Vote NO" alternative is equal to the surrender of everything you AND YOUR FAMILY have without question at ANY TIME. That is an unacceptable choice for any person who is depending on finishing their career at MCC. Way too much risk. Why would anyone choose to have no voice in regard to their job or career?
Now is the TIME to reach down deep within yourself - for yourself - and everyone else who did vote yes. Together you will have a better chance to keep what you have and even improve on what you have!

Thanks for all of your calls and emails. I am trying to answer all of you and keep up on here too. I will answer everybody that contacts me - promise.

Don't be fooled you guys.........TONY IS NOT BEING TRUTHFUL (What a surprise from these guys.)
Tony is making his rounds and I have a problem with what he is saying to you. He is threatening you with the SAME EXACT WEAPON HE HAS BEEN BEATING YOU WITH AS A NON-UNION WORKER AND NOW HE CLAIMS THAT WEAPON CAN ONLY HIT YOU IF YOU ARE A MEMBER OF IBEW 363.
That's Bull Tony. You already sliced THE PEOPLE and FROM NOW ON we want to NEGOTIATE.
He purposely paints you all a blurry picture, so let me clear it up a little.
First Let's talk about what Tony DOES NOT AND CANNOT SAY:
"WITH NO UNION YOU WON'T LOSE ANYTHING EVER AGAIN."
"WITH NO UNION YOUR HEALTH BENEFIT CONTRIBUTION WILL BE LOWERED OR STAY THE SAME."
"WITH NO UNION WE PROMISE NOT TO COMPARE YOUR WAGES TO JACKSONVILLE."
"WITH NO UNION WE WILL NOT MAKE CHANGES THAT WILL COST YOU ANY MORE MONEY."
"WITH NO UNION OR CONTRACT YOU HAVE MORE RIGHTS."
"WITHOUT THE UNION YOU WILL GET RAISES."
"WITHOUT THE UNION I WILL CONTINUE TO PAY THIS MUCH ATTENTION TO YOUR NEEDS."
Tony cannot make those statements because they ARE NOT TRUE!
THE TRUTH IS THAT THEY ARE PLANNING to ATTACK WHAT YOU ALREADY HAVE - AND WITH IBEW LOCAL 363 THERE AS YOUR REPRESENTATIVE - Tony won't have the CAKEWALK that he WILL have IF he can keep you without a contract.
It's really very simple. Enslaved people have jobs but have no rights. How much do you really want to have in common with that? I would have to say PROBABLY NOTHING, WOULDN'T YOU?
TONY WANTS YOU TO VOTE "NO" FOR HIM - NOT YOU:
Don't forget there is a REWARD FOR TONY if he keeps you NON UNION.
Maybe Tony gets a cool Million.......must be WORTH A HECK OF A LOT! HUH GUYS?

Nice touch too Dan, Tony and the rest of you - using drug tests to scare the people.We will still have drug testing in the contract - don't get me wrong.
The difference will be that after the contract is signed you won't be able to fabricate the "random" part anymore. I'm taking that tool you have available to harrass people who don't do drugs but do things you don't like - like call in the union.

Tony is coming back. Can you hang on? Don't let him make you feel guilty for protecting YOUR FAMILY BY GETTING A WRITTEN CONTRACT.

You do not know what you can expect from ABINBEV but you DO KNOW that you are better off bargaining about it all together. No matter WHAT Tony says - you NEED that contract. How come he has a contract but he doesn't want you to have one? Is he better than you guys now? Who does he think he is?

HE KNEW THAT you would appreciate your health coverage more if you paid more. TONY DECIDED TO DO THAT FOR YOU - HE DECIDES WHAT HAPPENS.

Tony will approach all of you and explain that all you need to do is trust him. Well, I have a question Tony - why can't we still trust you after we choose to join IBEW Local 363? We are NOT going to change - we will STILL be those HARDWORKING and LOYAL to the company workers - even with OUR union.

Which Side Are You On? IBEW Local 363 Welcomes All Fence Sitters!
Which side are you on? Do you know yet? Still on the fence? Can't be. Deep down you must have made your mind up. There are probably no fence sitters anymore - everyone now has a side to support in this. Don't forget - The most IMPORTANT one of those sides is your own.
I TRUST that the large MAJORITY OF PEOPLE will VOTE YES FOR THEMSELVES AND THEIR CO-WORKERS. I BELIEVE EVERYONE UNDERSTANDS THE RISK OF WORKING WITHOUT A CONTRACT IN THIS CORPORATE WORLD WE ALL WORK WITHIN. YOU NEED TO VOTE YES IN ORDER TO HAVE PARTICIPATION AND PROTECTION.
Your fellow workers - who are on your side - came to the IBEW Local 363 and asked us to help them orgainize. They said they just wanted to PROTECT THEIR FAMILIES AND GET A WRITTEN CONTRACT.
None of that has changed since that day. Those are still the goals here.
Then on July 11 the workers at the Newburgh Can Plant came to the IBEW Local 363 Building to ask questions and get the answers they need to move forward. There were honest discussions about what options were available to all of you as you continue your new working life with the new company - ABInbev.
We answered any question that anyone wanted to ask. At least two people who came were openly not supporters - and they were welcomed and given plenty of time to hold the floor. We thanked them for coming even though they didn't seem to want a union and we made them feel welcome and free to ask their questions.
IT HAS BEEN OBVIOUS FOR ALMOST TWO SOLID MONTHS NOW that the workers at the plant have seen that coming together as a SOLID GROUP is the best alternative to protect everyones future in Newburgh.
Want a little proof of the strength in your numbers? Look at all the people FLYING IN AND OUT and the money being spent REACTING TO WHAT YOU ARE DOING AS A GROUP. What else could ANYONE of you have done INDIVIDUALLY TO GET TONY AND KEN to fly here?
If this was a question about your benefits or how your pension is doing I don't think they would put your little concern on the top of the "ta do" pile, AND FLY OVER AND SPEND $85,000 EDUCATING YOU - do YOU ?
This is an effort to get some stability, to have a voice at work and to have the rules that we are going to work under ON PAPER - IN CONTRACT FORM. A contract that has to be negotiated and agreed to by both parties in order for it to change.
THERE ARE MANY UNKNOWNS AHEAD - YOU ALL NEED THE PROTECTION OF A CONTRACT AND THIS IS HOW YOU GET ONE - YOU JOIN A UNION. To some people that is a scary thought. They have heard stories or had a bad experience. I can only answer for IBEW Local 363 - and there will always be an answer.

We are not after you to make money, collect dues or to fool you into anything. We are one of the most agressive, active and professional unions in the entire Hudson Valley and we reacted to a request from your fellow employees to come in and HELP you.

No more dancing and mocking the people Warren. You are another reason why the people called in IBEW Local 363 and I just wanted Tony and Brito to know that your dance is one of the highest rated insults discussed among the people. Dan is a close second with his mono-tone, death inducing speeches.
But the highest rated insult of all came from Ranjive Bhalla - he explains that the people don't need the union because he and the other management royalty are like the PARENTS and the hard workers who sweat and make the cans are the CHILDREN.
That was worth - conservatively 25 votes swinging for

You guys are the REAL DEAL. You are very smart and intelligent people and we will work well together. People talk about the union. The union this and the union that. But really the union is the people in it.
Your unit of ABINBEV WORKERS of IBEW Local 363 is YOUR PART of
IBEW Local 363. That is the really great part. Your contract is YOUR contract and you guys are "the union" in the purest sense of the word. Yes, your IBEW representatives will do the negotiating and grievances and bargaining etc, but the YOUR PART OF THE UNION is YOURS.

You also made a comment that IBEW Local 363 was weak.
Why do you say that when I offered JUST YESTERDAY TO ALL WORK TOGETHER? I asked you to call me - you never called Tony. Why? If I am weak you will have an easy time. I also wanted to debate you Tony - I still do - if I am weak - bring me in and show the people how weak I am.

It is so clear that there has been talk already about what happens AFTER the election. For those that missed it, it is written on this site a few stories back under "To Clear Up Kens Lies..." in a very concise, easy to read outline. AFTER August 28th, the people WILL HAVE THEIR CONCERNS HEARD by both the UNION and the COMPANY.
IBEW Local 363 is ALREADY PREPARING FOR OUR WORK AFTER THE ELECTION. WHEN THE PEOPLE CHOOSE IBEW 363 WE WILL COME RIGHT OUT OF THE STARTING GATES.
WE NEED YOUR INPUT. WE WANT YOUR INPUT. YOUR COWORKERS NEED AND WANT YOUR INPUT.
I know that you are probably not USED TO GIVING YOUR INPUT but it is a new day for workers in MCC. YOUR OPINION COUNTS NOW - WELL, AFTER AUGUST 28 IT WILL.
The UNION will hear the concerns and formulate a plan WITH THE PEOPLE to have them brought to the table to discuss them with Ken or Dan or Tony or whoever they decide to have negotiate for the company.

The COMPANY will hear the peoples concerns and they care so much about you all that they will be nothing but fair.
THE PEOPLE WILL HEAR THE COMPANY REACTIONS TO ALL OF THOSE CONCERNS. THEY NEED TO KNOW WHAT THEIR MANAGEMENT NEGOTIATORS THINK OF THEM.
SURELY THERE WILL BE A SHINING AND CARING REPORT COMING BACK TO THE PEOPLE ON THAT! Just judging from all of the time and caring hours they SPENT TOGETHER with you all in your captive meetings. RIGHT KENNY?

Let's clear something up for the management side of this election. Nobody has said that MCC Newburgh is not a good place to work. It is a good place to work. In fact, every employee working is there because they want to be there. Actually, these jobs are WORTH defending. There is a standard of living that has been created and the workers want that standard to not only stay high but to improve it over time and become an even better place to work.
For ALL of those reasons - we want to become ORGANIZED AND PART OF IBEW LOCAL 363 and we want A WRITTEN CONTRACT. That is the only way to protect our selves, our jobs and our families.
We need security - security that is in the written form of a legal contract.
We do not desire an unreasonable contract that will cause economic harm to the company. We want a fair and reasonable contract that reflects what we have, what we want and rewards the hard work and sweat that WE the people put into that building and those machines EVERYDAY.
We make the profits that the big people share in their bonuses. We sweat EVERYDAY to make those cans. We know that we won't be getting any $35 Million dollar bonuses but can't we have a slice of the pie?
We should not be looked upon by our managers as ungrateful, selfish or different - actually, we should be looked at as courageous and principled people who work hard for their paychecks and who took the steps needed to protect ourselves as is our AMERICAN RIGHT TO DO.
Let's turn this thing around. Let's make it work for everybody.

IBEW LOCAL 363 - HAPPY TO HELP AND ANSWER THE PEOPLES CALL!
BUT SOME of your co-workers STILL NEED YOUR HELP. They are not sure of which direction they want to go in this election. They have not yet realized the ABSOLUTE value of a written contract. They MAY be on the "fence" mostly out of fear. FEAR of retaliation from the company. Fear of being punished. Fear of being "found out".
Those employees WILL GET YOUR HELP TOO. The majority of YOU - their co-workers - WILL REACH BACK AND BRING THE REST OF THE FENCE SITTERS FORWARD WITH US ON AUGUST 27/28.
YOU WILL HELP THEM NOW BY VOTING YES IN OVERWHELMING NUMBERS. Don't crowd them now. Let them make up their mind either way.

The Labor Board gets the cards and keeps them. No one sees them again.
The Labor Board compares them to a list of employees to make sure more than 30% signed the cards.
The Labor Board schedules a pre-election hearing and election date within 42 days.
Both parties have the 42 days to contact and speak with the workers.
The election date comes.

In about July 1994, the Union began organizing Respondent’s employees at the Newburgh facility. A petition was filed on August 18, and an election was held on October 6, which the Union lost..........THAT WAS THEN - THIS IS NOW.

EXCERPTS and COMMENTS ABOUT A DECISION OF THE NATIONAL LABOR RELATIONS BOARD
Respondent’s Newburgh, New York facility operates 24 hours per day, manufacturing beer and soda cans. Its approximately 175 employees (called team members) are assigned to one of four crews, each of which has a supervisor and a superintendent.
The plant manager is Tony Bhalla, and Brenda Danforth was the human resources manager at the facility.
Respondent (MCC) waged a campaign in which it sought to persuade employees to vote against the Union.
In-plant, and offsite meetings were held, and speeches and videotaped messages by Respondent’s corporate officials were presented.( sound familiar? )
An employee, who testified that during the campaign further stated that he wore an antiunion button which bore the initials “FTU.” He told Bhalla that the letters stood for “f*ck the union—fire the useless.”
According to the employee, Bhalla told him that “we know who they are and we’re gonna get them.” (Is this the caring Tony I heard so much about?)
It should be noted that the employees pretrial affidavit, given only 1 week before the hearing, stated that Bhalla remarked, “[W]e should fire them all.”

Bhalla testified that he said nothing to the employee about firing employees who supported the Union, and that the employee's explanation of “FTU” was “fire the useless.” ( That is not what you were told Tony )

I credit the employee’s version of his “FTU” conversation with Bhalla. ( The Judge is saying Tony LIED on the stand )
It is clear that the button was directed toward the Union as it was worn in response to the union supporters’ wearing of their union buttons. It is logical to assume that the employee, who did not support the Union, would have had the confidence of Bhalla,
and it is further likely that Bhalla would have made a statement to him relating to discharging union supporters. ( Man that hurts Tony. The Judge has you LYING twice and confirms that you DID SAY you would fire them all. Our caring little Tony, you are not.)
On these findings of fact and conclusions of law and on the entire record, I issue the following recommended

The Respondent, Metal Container Corporation, New Windsor, New York, its officers, agents, successors, and assigns, shall
1. Cease and desist from
(a) Discharging or otherwise discriminating against any employee for supporting the United Steelworkers of America, OR ANY OTHER UNION
( like IBEW Local 363 ).
(b) In any like or related manner interfering with, restraining, or coercing employees in the exercise of the rights guaranteed them by Section 7 of the Act
So now we have the pleasure of having TONY FLY IN NEXT to explain why we don't need the IBEW, Local 363 or A CONTRACT IN 2010 -
16 years later.

Ken The Negotiator - Beat It - You Lied Already!
Ken starting out with an $800 dollar lie wasn't a good strategy. The people don't believe anything you say. They know you are a just high paid shill - not sent here to negotiate - but sent here to first scare the people and second to muddy up the system. This ain't my first rodeo cowboy.
While I have your attention Ken because I know you are reading this - how much MONEY do YOU make per year? Dan started this craze of putting peoples salaries up for the crowd to see - what's yours Ken. We need to ADD YOUR SALARY into the total CAPTIVE MEETING COSTS.
I bet Dan is glad you are here though - it takes my attention off of him a little. He is just too easy. Brito knows that.
Let's talk about caring. Dan and Ken both have meetings with the people and show how much they care. They give advice. They show films. They have papers. They want the people to make sure they make the best decison for themselves. They bring you in and talk one on one. They stop production and have a group meeting for an hour and a half. They care and show they understand. They want to help you and your family.
Do you then not agree that if Dan and Ken change on August 29th AND BECOME DISTANT, UNCARING AND SPITEFUL that both of these people were not EVER being truthful to you.
That would be a shame. They were not caring about you at all - they were lying to you for the benefit of the company - to keep you without a contract.
If they stay true to their word they will have credibility with you AND with your union. WE will test this and WE will see who is caring for whom before AND after the election.
In fact, THE WHOLE WORLD MAY END UP SEEING IT.
KEN THE NEGOTIATOR has no allegience to you AT ALL so I can see him blowing it FIRST........RIGHT AFTER THE IBEW GETS IN THERE.
IBEW Local 363 has been upfront and open for this entire time. We have not lied, not once. There have been so many out and out lies that Dan and now Ken have told it borders on the ridiculous. I mean, Kens baggage wasn't unpacked and he told a huge one in his first meeting about initiation fees. Problem for Ken is THERE ARE NO INITIATION FEES AND HE SAID THEY COST $800.00!

ABINBEV PROFIT UP 7.5 % to $1.15 BILLION
BRUSSELS (AP) -- Anheuser-Busch InBev NV, the world's largest brewer, said Thursday that the World Cup helped push up sales in the second quarter, boosting net profit by 7.5 percent to $1.15 BILLION.
The producer of Budweiser, Stella Artois and Beck's said results this year beat its own expectations and those of market analysts and will continue to grow through 2010.
Revenue rose 4.1 percent to $9.2 BILLION in the second quarter. The Belgium-based company said beer sales rose 2.0 percent, with soft drinks up 5.5 percent, and that good weather "helped drive volume growth, except in Asia."
AB InBev markets more than 200 beer brands worldwide, including Brahma in Brazil, Jupiler in Belgium and the Netherlands, Quilmes in Argentina, Harbin in China and Budweiser in the U.S.
The company said the World Cup was a boon for Budweiser, its most recognizable brand but one that has been steadily losing market share over the last 20 years.
"Thanks to Budweiser's 2010 FIFA World Cup sponsorship (the brand's) volumes were essentially flat in the first half of 2010," said Anheuser-Busch InBev.
"We are quite pleased by that performance. The brand had been declining for a long period of time," said Felipe Dutra, the chief financial officer, in a telephone news conference.
The company expects profits to keep rising for the rest of the year, helped by a rebound in sales from last year, when key markets worldwide were hit by recession.
AB InBev said it will continue to pay special attention to Budweiser.
Hoping to build on the impact on Budweiser of its World Cup sponsorship, Bud Light will become the official and exclusive beer sponsor of the National Football League, beginning with the 2011 season.

I got a call from someone today offering to spread our story NATIONWIDE. I don't think that is the thing to do right now and I told the person that. We don't need to do that - but it's just good knowing WE CAN - if we need to.
It is a GREAT STORY though.....American Workers, who worked for American Icon Anheuser Busch get sold to foreign owners who openly bragged that they will cut workers compensation and increase the top 40 executive bonuses. Americans excercise their RIGHTS to form a union - and the company________________.
....so many good ways to end that.
Here's one:
American workers in MCC Newburgh excercise their RIGHTS to form a union - and the company _______________allowed the people to really excercise their right to form a union, promised they would not tell outright lies to interfere with that right, respected the peoples decision and in the end sat down at the table, bargained fairly and came to an agreement that was good for both parties.
GOOD NEWS: I also recieved emails today from three very influential people offering help if we need it across the other plants in the country. I also said no to that. We do not need to go there yet.
Americans love a good fight - especially over something that was always considered so LOYAL and so AMERICAN.
WE will resolve this right HERE DIRECTLY with ABINBEV and make this place something to be proud of for us all. At least that is the peoples intention and IBEW Local 363's intention.
Otherwise we have some real good options...

Well, that is all fake. Carlos doesn't really like negotiations. Actually, negotiations are bad, not good - the video you all watched of a happy smiling Carlos bragging about what great negotiations they had with AB and how they all worked together - didn't really happen. You eyes and ears were mistaken. Negotiations just don't work. In fact, when you negotiate - you just lose.
There is NO WINNING when you negotiate - just ask KEN THE NEGOTIATOR - he will tell you.
In retrospect - Carlos would probably have liked it better if AB JUST DICTATED THE TERMS OF THEIR AGREEMENT TO HIM.

CAUTION: Don't Follow Dan Down A Crooked Path Of Misinformation
Don't follow Dan down this crooked path he is trying to lead you down. The one with NO CONTRACT AT THE END. Make no mistake, there is nothing straight about Dan. He is just full of lies and misinformation. Worse yet, he is purposely zigging and zagging around the question THAT HE NEEDS to answer:
"HOW are we better off without negotiating OUR OWN written contract?"
He hasn't and cannot answer that with an intelligent answer. He can regurgitate words for an hour and a half that don't really mean anything but he cannot answer that.
Also, I have just read Dan's response to his questions that I answered about A MONTH AGO. Way to stay on top of things Dan. If any worker has a question - as always just feel free to ask it right on this site. I will always give an honest answer and most of you know that already.
Best of all - I will answer right away - a big difference from Dan never answering or taking a month to answer OR his sidekick telling you to call the company 800 number.
$298,000 Dan?? - Now I know WHY you didn't answer that one. Sorry, but you started it - moneybags.
But anyway - HEY EVERYBODY, according to Dans letter you don't need the union because YOU HAVE DANS PERSONAL COMMITMENT that "we will keep working at getting better."

....and as for DISCIPLINARY ISSUES OR GRIEVANCES OR PROBLEMS BETWEEN WORKERS........I hear DAN even runs a great KANGAROO COURT.

He proudly speaks of "coming to the table" and bargaining fairly, "reaching an agreement" or "an agreed deal in a friendly fashion", "entering into negotiations", he acknowledges that and says "working together we can do more". He says "not at all" to any changes to employees. He talks about "having a game plan", "working hard" to "build this great company together", of "rolling up our sleeves" and "working together as a team" and the ultimate - to "make our dream come true".
IT SEEMS THAT CARLOS BRITO is in full agreement with IBEW Local 363 on all of the above. We believe the SAME THING SHOULD APPLY TO THE NEWBURGH PLANT WORKERS. WE JUST WANT ALL OF THAT TALKING, SITTING AND BARGAINING TO ALSO BE DONE FOR THEIR BENEFIT - SO THEY CAN FEEL THAT THEY ARE REALLY PART OF THIS NEW COMPANY.
THE WORKERS AT THE NEWBURGH PLANT NEED A CONTRACT TOO - JUST LIKE THE CONTRACTS INBEV SIGNS EVERYDAY FOR EVERYTHING ELSE THEY DO.
